WinCALIS License Agreement

 IMPORTANT: READ CAREFULLY BEFORE OPENING.

By opening your sealed software package, you indicate your acceptance of the following Humanities Computing Laboratory license agreement. Please treat this agreement as valuable property as it is your proof of purchase and your key to receiving technical assistance.

 WinCALIS means Computer Assisted Language Instruction System for Windows as copyrighted by the Humanities Computing Laboratory at Durham, NC USA.

COPYRIGHT PROTECTION

The Product is owned by the Humanities Computing Laboratory and is protected by the laws of the state of North Carolina. You must treat the software as if it were a book (e.g. you may loan the software to someone, but you must not retain a copy for your own use if you do). Failure to adhere to the provisions of the License will result in termination of the end-user's right to the License, at which time the end-user must surrender the Product to the Humanities Computing Laboratory and destroy any copies or datasets created with the software.

LICENSE PRIVILEGES

In consideration of your payment of the agreed purchase price and your agreement to these terms, you are hereby licensed to the use of the software. You may:

LIMITED WARRANTY

The Humanities Computing Laboratory warrants that the Programs will perform substantially in accordance with the supporting documentation (i.e. information describing the format, organization, and content of machine-readable diskettes) for a period of 90 days. All other warranties, express or implied, are disclaimed. There are no warranties of merchantability or fitness for a particular purpose. Any liability for consequential damage is disclaimed.

END-USER REMEDIES

The Humanities Computing Laboratory's sole liability and End-User's sole remedy shall be, at the Humanities Computing Laboratory's option, either to (a) return the price paid by the End-User, or (b) repair or replace the Program that does not meet Duke University's Limited Warranty, which is returned with a copy of the End-User's receipt. The End-User shall not be entitled to any benefit under the Limited Warranty if failure of the Program has resulted from accident, abuse, or misapplication. Any replacement Program will be warranted for the remainder of the original warranty period or 30 days, whichever is longer.

LIMITATION OF LIABILITY

In no event shall the Humanities Computing Laboratory or its suppliers be liable for any damages whatsoever (including, without limitation, damages for loss of profits, business interruption, loss of information, or other pecuniary loss) arising out of the use of or inability to use the Product, even if the Humanities Computing Laboratory has been advised of the possibility of such damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

GOVERNMENT END-USERS

The software and documentation accompanying it are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1)and (2) of the Commercial Computer Software-Restricted Rights clause at FAR, 48 CFR 52.227-19, as applicable.
